For instance, till June last year, public lender State Bank of India provided home loans at an interest rate of 9.20 per cent. For loan against property, SBI charged an interest between 10.77 per cent and 11.75 per cent, depending on the amount of the loan.

    There are also, no tax benefits for salaried employees while paying the mortgage loan, unlike in a home loan. For a home loan of up to Rs 28 lakh fall under the purview of the priority sector lending. Mortgage loans, on the other hand, do not come enjoy this tag.

This means that if SBI is currently offering home loans at 7% per annum, a woman borrower will be given this loan at 6.95%. Note that a 100 basis points make up for one percentage point.

    ICICI Bank

    Apart from getting a lower rate of interest from this private lender, a female borrower will also enjoy ease of doing business at ICICI Bank.

In some cases, the bank may offer a lower interest rate, too.

  • About 20,000 housing societies in Maharashtra can gain from cooperative bank funding

    The housing finance limit of 5% of the total asset is expected to boost self-development of societies in Pune, Mumbai, and Thane, Maharashtra Housing Federation vice-chairman Suhas Patwardhan said.

    PUNE: Nearly 20,000 housing societies and apartments planning self-redevelopment in the state will benefit from the RBI’s decision to allow cooperative banks to grant finance for the commercial real estate-residential housing segment.

    The housing finance limit of 5% of the total asset is expected to boost self-development of societies in Pune, Mumbai, and Thane, Maharashtra Housing Federation vice-chairman Suhas Patwardhan said.

    “Real estate projects involving redevelopment are key areas in the property market, especially in growing cities.As per the RBI notification, all district cooperative banks and state cooperative bank will be able to grant loans to housing societies for self-redevelopment instead of them handing over the project to a developer for commercial real estate-residential housing according to the notice on June 8,” Patwardhan added.

    The decision is expected to open more liquidity and financing avenues for real estate development. Federation members said that it will help housing societies implement the 2019 GR to promote self-redevelopment.

    Bank manager Shrikant Karegaonkar said that the RBI monetary policy has doubled the limit of housing loan for cooperative banks. “It will help reduce the impact of inflation by pumping more funds into the housing sector and open opportunities to customers with the cooperative sector,” he said.

    Members of housing societies said that while 5% of the total assets looks small compared to the demand, the limit may be extended and it was a good beginning.

    According to the ‘Bulls and Bears’, Indian valuation handbook, Indian real estate segment shows a good growth with largest ever launch in the pipeline by most real estate companies

    Motilal Oswal Financial Services Limited’s (MOFSL), India valuation handbook ‘Bulls and Bears’, May 2022 edition stresses on the fact that the fear of inflation is overdone and the realty segment will see a good growth going forward.

    According to the report, most Indian real estate companies have witnessed a 10%-15% rise in construction costs. Now even if the cost is around 25%-40% of the sales price, the overall impact on margins is restricted to 3%-4% only and the realty companies have been able to push a price hike of 5%-8% on portfolio level comfortably.

    Strong pre-sales

    Affordability, rising need of home ownership and sector consolidation etc. have paved the path for the Indian real estate sector to again see strong pre-sales momentum since the onset of Covid-19. The handbook mentions that with the largest ever launch in the pipeline by most Indian real estate companies, the Indian realty segment is expected to see a healthy demand in the near future.

    Reduction in inventory overhang

    Since 2013-14, though the housing demand has remained stagnant, the inventory levels have seen significant correction driven by consistent decline in new launches. As per MOFSL, unsold inventory has dipped notably to 4, 37, 000 units from the peak of 7, 70, 000 units in CY13 with the overhang now reducing to 23 months.

    Impact of interest rate hike

    According to the MOFSL report, while the impact of interest rate hike is expected to be minimal in spite of a similar hike which was made recently, it can have a negative impact as the rates start moving closer to 8%. In that case, most developers will have a 10%+ borrowing cost and this will in turn have an impact on their return profiles.

    Realty sector valuation

    The report highlights that the top 12 listed companies posted 43%/45% YoY growth in bookings in FY21/FY22. This should have ideally resulted in further re-rating of the stocks, but the rising cost pressure along with recent interest rate hikes have built in expectations of margin erosion and demand slowdown. Hence, post the recent correction, many stocks have now entered the value zone.

    The sector valuation has corrected to below its long-term average P/E of 23.2x and is now trading at 21.2x on a one-year forward basis.

  • Govt in final stages to approve property cards for flats registered under MahaRERA

    The scheme will ensure independent property cards for flats (vertical properties) with details of carpet area, amenity space, bank loan information and 7/12 extracts.

    PUNE: : The Maharashtra government was in the final stages of discussion and approval of the draft to issue property cards to flat owners for projects registered under MahaRERA, a senior revenue department official said on Tuesday.

    The scheme will ensure independent property cards for flats (vertical properties) with details of carpet area, amenity space, bank loan information and 7/12 extracts.

    The draft had drawn a lot of suggestions and objections and a committee was appointed to submit the views to the state before the scheme came into place. “The final draft has been submitted to the government and is likely to be approved in the Assembly session in July,’‘ said the official in the know-how of the proposal. The aim of starting the property cards is to map the vertical growth in cities and rural belts and maintain an independent record of rights and register for the individual apartments and units in the projects registered with the Maharashtra Real Estate Regulatory Authority (MahaRERA).

    The committee for the vertical property cards had earlier submitted its recommendations to the government and suggested the implementation of the scheme in phases. Discussions are on with MahaRERA officials and the government will take the final call once the government clears the draft.

    The state issues property cards for urban areas and 7/11 extracts for rural areas. These cards define the ownership rights of an individual or multiple people. However, there is no document available that proves the ownership of a person owning a flat in a building constructed on a particular plot.

    “Keeping this in mind, the revenue department decided to introduce the Maharashtra Land Revenue Code, Record of Rights and Registers for Apartments and Buildings Rules under the Maharashtra Land Revenue Code, 1966. This allows the state to provide a property card for flat ownership. Maharashtra has around 56 lakh property cards for plots in the city areas and 2.5 crore 7/12 extracts,” the official said.

    Once the new rules are implemented, the current property cards, or 7/12 extract, will become the principal document of ownership. The property card, on the other hand, would act as the supplementary document for the apartment holders, the official said.

    A revenue department official said the new record was a push toward cleaner property titles, which would make buying and selling of apartments less prone to risks.

    The official said the document might also make the process of getting loans from banking institutions less cumbersome for the consumers.

Buyers can avail information regarding these properties on their respective State’s RERA website and even seek speedy grievance redressal by the Appellate Tribunal formed under RERA.

    One of the prime advantages of a ready unit is the absence of any waiting period. All you have to do is make the payment, go through all the documentation work and move in.     Under-Construction Property

    Higher risk:
    There is an element of risk involved when it comes to investing in an under-construction project. There have been cases when the builder has failed to deliver on time or in some severe cases, failed to deliver at all due to various reasons such as funding crunch, rise in the cost of construction materials and increase in lending rates, among others. It is, thus, imperative to do a detailed background check of the builder before investing in an under-construction project.

    Discrepancy in the final product layout/features:
    One of the most common glitches associated with under-construction properties include the peril of not getting the promised product at the time of possession. Usual incongruities include lesser usable area than promised, changed layout and deficient amenities.

    GST Implication:
    Purchasing an under-construction property will attract a tax incidence of five percent of the total cost of property. Stamp duty and registration charges will have to be paid separately, resulting in heavy expenditure on taxes. Affordable homes priced under Rs 45 lakh attract one percent GST of the total cost of property.

    Tax Implications:
    Buyers usually finance their home purchase through loans, which are linked to certain tax benefits under section 24, 80EE and 80C of the Income Tax Act. The benefits under these sections are restricted to only ready-to-move-in properties, once the possession has been taken over by the buyer. The tax benefits on the interest paid during the construction of a property can be claimed in five equal instalments beginning from the year of possession.

    However, there is a catch here. The tax exemption amounting up to Rs 2.5 lakh on the interest paid on a home loan for a self-occupied property is applicable if the construction gets completed and the homeowner shifts in the house within three years of availing the home loan. In case the construction does not get completed within three years, tax benefits amounting only up to Rs 30,000 can be claimed. These conditions are applicable only if the property occupied by the owner. In case, the owner decided to rent it out or leave it vacant (deemed let out), there is no restriction on the amount of interest deduction. As far as the tax exemption on the principle amount is considered, if the borrower ends up paying the entire sum before possession, there is no rule to claim back any reimbursement for the principle amount. Since projects delays have become so very common these days, those who take home loans on under-construction properties risk losing out on the account of tax benefits. With the uncertainties of Indian real estate, delay in the delivery of a project is quite common. Thus, with under-construction properties you have the risk of losing out on the tax benefits.

    Ready-to-move-in Property

    High Cost:
    One of the most obvious drawbacks of buying a ready-to-move unit is the higher cost as compared to an under-construction property. As mentioned above, the cost difference could be anywhere between Rs 20-30 per cent.

    Quality of construction:
    In case of an under-construction property you have the option of evaluating the work progress and thus being aware of the quality of construction in terms of the materials used, strength of the foundations etc. However, in case of a ready unit, you cannot conduct any such checks.

    Age of the property:
    Unlike an under-construction property, buying a ready unit might not always ensure you a brand new home. It might have been in up for sale for a long time. Hence, if it has not been maintained properly, it might start looking old.

    Exclusion from RERA:
    Old ready units with Occupancy Certificate as on 1 May, 2016, are not mandated to be included under RERA. As a result, its promoters are not liable to make its information available on a public platform.

    CAPITAL GAINS TAX

    In case you plan to buy an under-construction property by selling off an already existing asset, the construction of that should complete within three years from the sale of the property. If the construction takes longer than three years, the Long Term Capital Gains (LTCG) from the sold property are taxed at 20 percent, coupled with the payment of cess and surcharge.

    Income tax rules allow tax exemption on the capital gains from the sale of a property that has been held for more than two years ONLY if the amount is reinvested in a property within two years or if it is invested in a house purchased one year before the sale of the asset or used to construct a house within three years. In such a scenario, if the developer delays the possession, you will end up paying a huge amount as ‘capital gains tax’.

    Under the RBI’s guidelines, a non-resident Indian (NRI) is allowed to purchase certain types of properties, while other forms of realty may require special permissions.
    A non-resident Indian (NRI), who is interested in buying a property in India, can do so. However, his property investment must be made in line with the provisions of the Foreign Exchange Management Act (FEMA). The same FEMA rules are applied to property investments by the people of Indian origin (PIOs).

    Properties NRIs, PIOs can invest in India

    The Reserve Bank of India (RBI) has given a general permission to NRIs and PIO to buy any residential or commercial property in India. They need not seek any specific permission from the central bank nor are they required to send any communication or intimation in this regard to the RBI.
    Under the existing general permissions, an NRI or PIO can buy any number of residential or commercial properties. The income tax law also allows an NRI/PIO to own as many residential or commercial property as he pleases.
    In case the NRI is unable to come to India, the documents pertaining to the purchase can be executed by any person, who is given a valid power of attorney. Under the RBI’s general permission, an NRI cannot purchase any agricultural land or plantation property in India. Consequently, under the existing regulations, NRIs cannot purchase farmhouses in India. So, if an NRI wants to purchase a farmhouse or plantation, s/he will have to approach the RBI for a specific permission and the RBI will consider this on a case-to-case basis.

    Joint ownership

    An NRI can purchase the property, either as a single owner, or jointly, with any other NRI. However, a resident Indian or a person, who is otherwise not allowed to invest in a property in India, cannot become a joint holder in such property, irrespective of the second holder’s contribution towards the purchase.

    Continuance of ownership of property, after becoming an NRI

    What if a person who owns properties in India, subsequently, becomes an NRI? Such a person can continue to hold the property in his name in India. An NRI is also allowed to continue to own any agricultural land, plantation property, or farmhouse that he owned when he became an NRI, which he is otherwise not allowed to purchase, after becoming an NRI. They are also allowed to let out the property, irrespective of when it was acquired. The rent received from such property, can be remitted, after appropriate Indian taxes have been paid on such rent.
    Likewise, any NRI is allowed to sell, or gift an immovable property to any person resident in India. S/he can also gift or transfer any property, other than agricultural property, farmhouse, or plantation property, to any NRI.

    • An NRI cannot buy agricultural land or plantation in India. However, they can buy residential and commercial properties. In case there is a reason behind scouting for agricultural land, the Reserve Bank of India (RBI) will review such interest on a case-to-case basis.

    • If you wish to authorise a trustworthy person, to conduct transactions on your behalf, such as registration of a property, you will need to give them a Power of Attorney (PoA). The PoA holder signs on the NRI’s behalf, by producing a copy of the PoA to the appropriate authorities.
    • Like any other resident of India buying a property, an NRI is liable to pay the required taxes – stamp duty, registration fee, post purchase annual property taxes and even GST in case of an under-construction property.
    • You can invest in a property in India to earn rental income, as well. However, you would be taxed at 30% via tax deducted at source (TDS), while the remaining amount may be repatriated under FEMA rules.
    • In the case of proceeds that are earned through the sale of an immovable property, it can be repatriated after deduction of between 20% and 30% TDS, depending on whether it is a long-term or short-term capital gain.
